1. General Agreement and Jurisdiction

1.1. Acceptance: These Terms & Conditions ("T&Cs") govern the purchase, access, and use of the Spoken English Program (“The Course”) provided by LTS ENGLISH EDUTECH operating via the platform LTSEnglish.in (collectively referred to as “The Company,” “We,” “Us”). By accessing or using this website, creating an account, or purchasing the Course, You (“Client,” “User”) agree to be legally bound by these T&Cs.

1.2. Jurisdiction: These T&Cs shall be governed by and interpreted in accordance with the laws of India. All disputes shall fall under the exclusive jurisdiction of courts in Warangal, Telangana.

The Maximum Retail Price (MRP) of the course is ₹4,999. The Company utilizes a dynamic, tiered pricing model based on enrollment volume. The Applicable Fee is the price displayed on the checkout page at the moment of purchase.

Current Pricing Schedule (Subject to Change):

• Tier 1: Bumper Offer – ₹499 (The Luckiest Deal).
• Tier 2: Golden Chance – ₹899 (Limited Lucky Offer).
• Tier 3: Smart Choice – ₹1,299 (Inclusive of GST).
• Tier 4: Final Call – ₹1,499 (Standard Entry).

Note: Fees may increase to the full MRP of ₹1,999 at any time. Enrollment and pricing tiers may pause or shift during administrative transitions (e.g., GST integration).

1.4. GST Invoicing: For Tier 3 and above, if the User requires a GST-compliant invoice for input credit, they must furnish their valid GSTIN at the time of purchase. Invoices cannot be amended retroactively.

1.5. Age Requirement: You confirm that you are 18 years or older. Minors must use the service under parental/guardian supervision.

2. Service Availability & Maintenance Disclaimer

2.1. No Guarantee of Uptime: The Course is provided on an “as available” basis. We do not guarantee uninterrupted, error-free, or continuous availability.

2.2. Downtime Acknowledgment: The User acknowledges that temporary unavailability may occur due to maintenance, server upgrades, or heavy traffic.

2.3. No Liability for Temporary Downtime: We shall not be liable for losses resulting from temporary downtime (less than 30 continuous days). No refunds will be issued for scheduled maintenance or technical glitches.

3. Refund Policy: All Sales Final

3.1. No Refunds (General Rule): Due to the digital nature of the Course and the immediate delivery of proprietary tools, all purchases are final and non-refundable once the account is activated.

3.2. Exception Policy (Strictly Limited): Refunds are ONLY considered if the entire Course platform is objectively technically inaccessible for a continuous period of 30 (Thirty) Days due to a verified failure of our internal systems (e.g., coding errors, internal server misconfiguration).

Partial Unavailability: The unavailability of specific videos, individual dictionary terms, or minor features does NOT constitute grounds for a refund, provided the User can still access the core platform and majority of the content.

IMPORTANT EXCLUSION (NO REFUNDS): The User acknowledges that NO REFUNDS will be processed if the downtime is caused by external events or criminal acts against the Company, including but not limited to:

• Domain Hijacking or Theft.
• Cyberattacks, Ransomware, DDoS attacks, or Hacking.
• Third-party hosting failures (e.g., AWS, Google Cloud, Hosting Provider outages).
• Internet backbone failures or Government-imposed internet restrictions.

In these scenarios, the Company is a victim of a criminal or external act and is not liable for refunds.

3.3. Single-Device Access Rule (Strict Enforcement): Your account is strictly limited to one active device at a time. Simultaneous login attempts or suspicious device-switching will trigger:

• Immediate account suspension.
• Permanent termination for repeated violations.
• No refund under any circumstances.

3.4. Payment Disputes: Initiating a chargeback without contacting support first constitutes a breach of contract. We reserve the right to suspend the account and recover dues legally.

4. Intellectual Property & Prohibited Use

4.1. Rights: All Course materials, videos, and dictionary tools belong exclusively to LTS ENGLISH EDUTECH.

4.2. Strict Prohibitions: You must NOT:

• Share your login details.
• Record or scrape Course content.
• Use our data to train AI models.
• Use the content for commercial teaching.

4.3. Penalty: Violation of this clause will result in immediate termination and potential legal action for damages.

5. User-Submitted Content

5.1. Responsibility: You are solely responsible for any comments, answers, or definitions you post.

5.2. Indemnification: You agree to indemnify LTS ENGLISH EDUTECH against any legal claims arising from content you submit (e.g., copyright infringement, defamation).

6. Academic Merit & Incentive Policy (Not a Lottery)

Important: All rewards under this section are strictly Performance-Based Academic Incentives. This is NOT a lottery, gambling, or a game of chance.

6.1. Weekly Proficiency Reward (Academic Grant):

• Program Activation: This specific weekly incentive commences strictly after the platform reaches 1,000 total active enrollments. No weekly rewards are awarded prior to this milestone.
• Incentive: ₹500 or ₹1,000 (awarded as a Scholarship/Learning Grant).
• Eligibility Criteria: Open to active students who have submitted all 7 Daily Quizzes with 100% correct answers during the qualifying week (Mon-Sun).
• Winner Announcement: Winners for the previous qualifying week will be announced on the following Wednesday.
• Selection Method: If multiple students achieve a perfect score (7/7 correct days), the winner is determined by Student Seniority (Tie-Breaker: Earlier Date of Enrollment).
• Reward Transfer: The reward amount will be transferred to the student's bank account within 15 days of successful verification of winner details.
• Limit: One reward per student lifetime.

6.2. Dictionary Contribution Grant:

• Milestones: Grant activates when the platform user base reaches 250, 500, 750, and 1,000 members.
• Incentive: ₹1,000 per milestone.
• Criteria: Awarded to the Top Contributor (Rank 1) based on the total count of valid educational definitions submitted.
• Winner Announcement: The winner will be announced within 15 days of the platform reaching the specific user milestone.
• Tie-Breaker: In the event of a tie in contribution counts, the winner is determined by Student Seniority (the student who enrolled in the platform earlier).
• Reward Transfer: The reward amount will be transferred to the student's bank account within 15 days of successful verification of winner details.
• Limit: One reward per student lifetime.

6.3. Discretion & Anti-Fraud:

The Company reserves the right to disqualify any user attempting to manipulate scores via bots, scripts, or multiple accounts. These incentives are gratuitous rewards for educational excellence and do not constitute a guaranteed contractual right.

7. Ambassador Referral Program

7.1. Activation:This program activates only upon official notification by the Platform (or after the "GST Compliant Phase" begins). The Platform reserves the right to approve or reject Ambassador status for any user.

7.2. Commission Structure:

• Fee: Flat ₹100 (One Hundred) per verified new User referral.
• Service Definition:The User acknowledges that this payout is strictly a "Business Promotion Fee" for marketing services rendered. It is not a commission, salary, or employment wage.

7.3. Payout Terms:

• Min Withdrawal: ₹1,000.
• Max Annual Cap: ₹14,500 per Ambassador.
• Tax Deduction: Payouts are made without TDS deduction as long as they remain below the statutory threshold (currently ₹15,000).
• User Responsibility: The User is solely responsible for declaring this income in their personal Income Tax Return (ITR).

7.4. Fraud & Disqualification

• One Reward Per Student:Rewards are valid only for the first-time purchase of a unique real student.
• Anti-Fraud:Self-referrals, duplicate accounts, or bot-generated registrations will result in immediate disqualification and forfeiture of all pending payouts. for marketing services rendered. It is not a commission, salary, or employment wage.

8. Disclaimers & Force Majeure

8.1. "As Is" Basis: We do not guarantee that this Course will result in specific career outcomes or fluency levels. Results depend on User effort.

8.2. Liability Cap: In no event shall LTS ENGLISH EDUTECH be liable for damages exceeding the actual fee paid by the User.

8.3. Force Majeure (Events Beyond Control): We are NOT liable for delays, data loss, or service failure caused by:

• Cyberattacks, Hacking, or Ransomware.
• Internet Service Provider (ISP) failures.
• Natural disasters or Government restrictions.
• Third-party platform outages.

Such events do not constitute grounds for a refund.

9. Account Termination

We may terminate access without refund if you:

• Violate the Single-Device rule.
• Engage in abusive behavior.
• Breach these T&Cs.

10. Arbitration

All disputes shall be resolved via binding arbitration in Warangal, Telangana, under the Arbitration and Conciliation Act, 1996.

11. Notices & Communication

Official notices will be sent via:

• Email provided by the User.
• Website announcements.
• In-app notifications.

12. Severability

If any clause is found invalid by a court, the remaining clauses remain fully enforceable.

13. Entire Agreement

These T&Cs constitute the complete and final agreement between the User and LTS ENGLISH EDUTECH, superseding all previous communications or representations.
